1. Introduction & Acceptance of Terms

OurFamilyFood.com is operated by GrifDigi Limited, a company incorporated in New Zealand ("GrifDigi," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of:

  • β€’the OurFamilyFood.com website,
  • β€’related web or mobile applications, and
  • β€’any services provided through them (collectively, the "Service").

These Terms constitute a legally binding contract between you and GrifDigi.

By accessing or using the Service, you confirm that you:

  • β€’have read and understood these Terms, and
  • β€’agree to be bound by them and by our Privacy Policy, which forms part of these Terms.

If you do not agree, you must not access or use the Service.

2. User Content & Ownership

A. Ownership of User Content

We do not claim ownership over any content you create, upload, or store using the Service ("User Content"), including but not limited to:

  • β€’recipes,
  • β€’family stories,
  • β€’notes,
  • β€’photographs,
  • β€’comments, and
  • β€’other personal or family material.

You retain all rights, title, and interest in your User Content.

B. Licence Granted to Us

To operate the Service, you grant GrifDigi a non-exclusive, worldwide, royalty-free licence to:

  • β€’host,
  • β€’store,
  • β€’display,
  • β€’transmit, and
  • β€’format (for technical display only)

your User Content solely for the purpose of providing the Service to you and to those you explicitly authorise. This licence ends when you delete the relevant User Content or close your account, subject to legal retention requirements.

C. Your Responsibility for User Content

You are solely responsible for your User Content. You represent and warrant that:

  • β€’you own or have the necessary rights to the User Content; and
  • β€’your User Content does not infringe any third-party rights or violate applicable law.

3. Sharing & Visibility of Content

The Service allows you to control how your content is shared.

  • β€’Private content is visible only to you.
  • β€’Shared content is visible only to those you invite.
  • β€’Public content (if enabled) is visible to those you authorise under that setting.

You control access permissions at all times. We do not override your sharing choices.

4. Spaces & Family Groups

Content within the Service is organised into distinct areas ("Spaces"), which may include:

  • β€’personal spaces; and
  • β€’shared family spaces.

Spaces are isolated from each other. Content is not shared across Spaces unless you intentionally copy or move it.

You may export your User Content at any time using available export features.

5. Subscriptions & Payments

Certain features may be offered on a paid subscription basis ("Subscription").

A. Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually).

Payment processing is handled by third-party providers (e.g. Apple App Store, Stripe), subject to their terms.

B. Auto-Renewal

Subscriptions automatically renew unless cancelled before the end of the current billing period.

C. Cancellation

You may cancel your Subscription at any time through the relevant platform or payment provider. Access continues until the end of the paid period. Fees already paid are non-refundable unless required by law.

6. Free Trials

We may offer free trials at our discretion. If not cancelled before the trial ends, the Subscription converts to a paid plan automatically.

We reserve the right to modify or withdraw free trials at any time.

7. Accounts & Security

You are responsible for:

  • β€’maintaining the confidentiality of your login credentials; and
  • β€’all activity conducted through your account.

You must notify us immediately if you suspect unauthorised access.

You must be at least 16 years old (or the minimum age required by your local law) to use the Service.

8. Acceptable Use

You must not use the Service to:

  • β€’infringe intellectual property rights;
  • β€’upload unlawful, harmful, or misleading content;
  • β€’harass, threaten, or abuse others;
  • β€’attempt to reverse engineer or interfere with the Service;
  • β€’access accounts or systems without authorisation; or
  • β€’violate any applicable law.

We reserve the right to remove content or suspend accounts where we reasonably believe these Terms have been breached.

9. Intellectual Property (Service Content)

The Service itself β€” including software, design, branding, and functionality β€” is owned by GrifDigi and protected by intellectual property laws.

You may not use our branding or proprietary materials without written permission.

10. Feedback

If you submit feedback or suggestions, you grant us the right to use them without obligation or compensation, provided such use does not disclose your private User Content.

11. Third-Party Services

The Service may integrate with or link to third-party services. We are not responsible for their content, performance, or privacy practices.

Use of third-party services is at your own risk.

12. Termination

We may suspend or terminate access where:

  • β€’these Terms are breached;
  • β€’the Service is discontinued; or
  • β€’required by law or security concerns.

Where practicable, we will provide reasonable notice to allow you to export your content.

13. Indemnity

You agree to indemnify and hold harmless GrifDigi from claims arising out of:

  • β€’your use of the Service; or
  • β€’your User Content.

14. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

  • β€’the Service is provided "as is" and "as available";
  • β€’we do not guarantee uninterrupted or error-free operation; and
  • β€’GrifDigi is not liable for indirect, consequential, or special losses.

Nothing in these Terms limits rights that cannot lawfully be excluded under New Zealand law.

15. Governing Law

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction.

16. Changes to These Terms

We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.

If you do not agree to updated Terms, you may stop using the Service.

17. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and GrifDigi regarding the Service.
